These terms describe the terms governing your use of the services provided by Hive Legal, PLLC, and its parent, subsidiaries, affiliates, and agents (collectively, “Hive Law”, “Hive.Law”, “we”, “our”, or “us”), and is a legal agreement between you and Hive Legal PLLC (“Agreement”).

Hive Law” is a state registered trade name of Hive Legal PLLC. A trade name is the name your business is commonly known as or the name you use when advertising or doing business. A trade name is also called a DBA (doing business as) name.

Your Use of This Website is Governed by These Terms and Conditions Agreement between user and Hive Legal, PLLC (DBA Hive Law).

These Terms and Conditions are an agreement (“Agreement”) between you and Hive Legal PLLC (the “Company”) regarding your use of the information, software, products, and services contained in or available through the Company’s website. The Company website is comprised of various web pages operated by the Company. The Company website is offered to you conditioned on your acceptance of the terms, conditions, and notices contained herein. Your use of the website constitutes your agreement to all such terms, conditions, and notices, including the arbitration provision and class action waiver below.

The information on this website is for general information purposes only. Nothing on this website should be taken as legal advice for any individual case or situation. This information is not intended to create, and receipt or viewing does not constitute, an attorney-client relationship. A formal attorney-client relationship is created when an engagement letter is signed.

Your use of the website does not create or constitute an attorney-client relationship between you and the Company, or any Company employee.  Instead, you are representing yourself in any legal matter you undertake through the Company’s asset protection service. Services & Scope of Work

By signing any contract (“Agreement”) with the Company, you are retaining us to represent you in a capacity limited to the delivery of the services described on the reverse side (“The Services” or “Scope of Work”) on the Agreement. We will review your individual circumstances, prepare documents, and assist you in filing applicable documentation with the appropriate jurisdiction(s). You are responsible for applicable filing and service fees assessed by the governing jurisdiction(s). We will provide status updates and send you copies of all appropriate documentation and other correspondence.

Your fee for the Services is described on the reverse side of the Agreement and or applicable online Agreement. Additional services outside the Scope of Work will require other written arrangements. All or part of fees paid for the Services are for “Legal Services” and are earned upon receipt. You are entitled to discharge Hive Law as your legal representative in connection with the Services at any time, with or without cause; in this event, you may be entitled to a full or partial refund of the fee based on the value of the representation provided. We reserve the right to terminate our attorney-client relationship for nonpayment of fees, nonpayment of retainers, or any other reason deemed appropriate under the Code of Professional Responsibility, including misrepresented material facts, failure to disclose material facts, or failure to follow our advice.

You agree to carefully read all statements for Services rendered sent to you by this office and to promptly notify this office, in writing, of any claimed errors or discrepancies in the Services within fifteen (15) days from the time you receive the Services. In the event you fail to do so, it will be presumed you agree with the correctness, accuracy, and fairness of the Services rendered to you. Our limited representation shall cease upon the delivery of the Services.

Fees and Renewals

From time to time, we may offer different subscription terms, and the membership fees for such subscriptions may vary. The membership fees are non-refundable except as expressly set forth below.

UNLESS YOU NOTIFY US BEFORE THE RENEWAL DATE OF YOUR MEMBERSHIP THAT YOU WANT TO CANCEL OR AUTO RENEW, YOUR SUBSCRIPTION WILL AUTOMATICALLY RENEW AND YOU AUTHORIZE US (WITHOUT NOTICE TO YOU) TO COLLECT THE THEN APPLICABLE MEMBERSHIP FEES, USING ANY VALID PAYMENT SOURCE WE HAVE ON RECORD FOR YOU.

Check Policy

Electronic Deposits: When you provide a check as payment, you authorize Hive.Law either to use information from your check to make a one-time electronic fund transfer from your account or to process the payment as a check transaction. Returned Checks: A $25.00 fee for returned checks or the maximum amount permitted by law will be assessed for the check not honored by your bank. Returned checks, along with the returned check fee, may be electronically presented to your bank.

CONSENT TO BINDING ARBITRATION BEFORE THE AMERICAN ARBITRATION ASSOCIATION

Most customer concerns can be resolved quickly and to the customer’s satisfaction by calling our customer service department at 480-801-9393. In the unlikely event that our customer service department is unable to resolve a complaint you may have (or if the Company has not been able to resolve a dispute it has with you after attempting to do so informally), by your use of this website, purchaser/customer (“Customer”) and Hive.Law, (“Company”) herby agree that any and all disputes that arise between them concerning this Agreement or any of the terms of this Agreement, or that concern any aspect of the relationship between Customer and Company, shall be decided exclusively in binding arbitration conducted by the American Arbitration Association (“AAA”). Customer and Company further agree that each party will bear his/her/its own costs and attorneys’ fees incurred in connection with the AAA arbitration proceeding and agree that the AAA arbitrator shall have no power or discretion to make any award of costs or attorneys’ fees. By agreeing to arbitration, you waive any right or authority for any claims to be arbitrated as a class action.

Cancellation Policy

If you cancel, in order to receive a refund, all materials received from Hive.Law must be returned. You may cancel this transaction, without penalty or obligation before midnight of the third business day following the above date. If you cancel, any property traded in, any payments made by you under the contract or sale, and any negotiable instrument executed by you will be returned within 10 days following receipt by the seller of your cancellation notice, and any security interest arising out of the transaction will be cancelled. To cancel this transaction, please call 480-801-9393 during regular office hours for fastest service. (Monday – Friday 9:00 am – 5:00 pm MST). You may also mail a signed and dated copy of this cancellation notice to Hive Legal, PLLC at 5505 W Chandler Blvd Ste 5 Chandler, AZ 85226.

Modification of these terms of use

The Company reserves the right to change the terms, conditions, and notices under which the website is offered, including but not limited to the charges associated with the use of the website.

You understand and agree that your use of the website after the date on which the Terms and Conditions have changed shall be treated as acceptance of the updated Terms and Conditions.

Links to third party sites / Third party services

The website may contain links to other websites (“Linked Sites”). The Linked Sites are not under the control of the Company and the Company is not responsible for the contents of any Linked Site, including without limitation any link contained in a Linked Site, or any changes or updates to a Linked Site. The Company is not responsible for webcasting, or any other form of transmission received from any Linked Site. The Company is providing these links to you only as a convenience, and the inclusion of any link does not imply endorsement by the Company of the site or any association with its operators. No unlawful or prohibited use

As a condition of your use of the website, you warrant to the Company that you will not use the website for any purpose that is unlawful or prohibited by these terms, conditions, and notices. You may not use the website in any manner which could damage, disable, overburden, or impair the website or interfere with any other party’s use and enjoyment of the website. You may not obtain or attempt to obtain any materials or information through any means not intentionally made available or provided for through the websites.

Unless otherwise specified herein, this agreement constitutes the entire agreement between the user and the Company with respect to the website and it supersedes all prior or contemporaneous communications and proposals, whether electronic, oral, or written, between the user and the Company with respect to the website. You may not assign or otherwise transfer the Terms and Conditions, or any right granted hereunder, without the Company’s written consent. The Company’s rights under the Terms and Conditions are freely transferable by the Company in its sole discretion. Any failure by the Company to enforce or exercise any provision of the Terms and Conditions, or any related right, shall not constitute a waiver of that provision or right. Any rights not expressly granted herein are reserved.

The Company may provide you with notices, including those regarding changes to the Terms and Conditions, by email, regular mail, postings on the website, or other reasonable means now known or hereafter developed.

A printed version of this agreement and of any notice given in electronic form shall be admissible in judicial or administrative proceedings based upon or relating to this agreement to the same extent and subject to the same conditions as other business documents and records originally generated and maintained in printed form. It is the express wish of the parties that this agreement and all related documents have been drawn up in English.
